The case: The plaintiff, the eldest son of the late Terence Benedict McQuaid (‘the deceased’) who died on 30 July 2018, sought a declaration that a Will purportedly executed by the deceased on 17 July 2018 (‘the disputed Will’) was invalid on two discrete grounds including that  the deceased lacked the necessary capacity at the time of execution.
