13 June 2022 Priya Vaidya 904 Case Updates MTT v Secretary of State for the Home Department [2022] UKAITUR PA117592017 byPriya Vaidya The case: The appellant, a citizen of Vietnam, born on 13 January 1972, entered the UK clandestinely on 13 September 2009 and claimed asylum on 2 July 2012. She claimed to be at risk from the 'black society' as her husband borrowed a large sum of money from them to feed his drug habit and she took over the debt since he was a drug addict and was incapable of paying back the loan. In 2003 three men visited her home, demanding repayment, threatening her with knives and threatening to kidnap her children, but she promised to repay the money the following year. In 2004 she paid back a portion of the money borrowed and she fled to another town in 2005 where she worked in a restaurant. She was found by the men and tied up, but she managed to escape. She then paid the men some more money but decided to flee Vietnam before the next payment was due. She travelled to Russia and then came to the UK on a false passport. She claimed to have been transported from Vietnam to Russia and then through Europe to the UK, and to have been sexually exploited and forced to work as a prostitute. The Competent Authority concluded that there were reasonable grounds to believe that the appellant had been a victim of trafficking.
