The case: Martlet Homes Ltd sought to recover approximately £8 million in damages from the defendant building contractor, Mulalley & Co Ltd for costs incurred in: (a) investigating and remedying, by removal and replacement, combustible external wall insulation rendered cladding and (b) providing a waking watch as a fire safety precaution until the EWI cladding had been removed.
